Most of us have had an accident or two in our lives which did not really amount to very much. However, there are those people who are injured to the point where they have to stop work for a while or even permanently. In either case, there is definitely a need to get some expert advice to guide them through what could be some very difficult times ahead. They are easily found, under the 'personal injury attorney' or 'personal injury lawyer' heading on any good search engine on the internet.
The problem when people get hurt is that, very often, the damage does not become apparent until it is much later on down the line. If claims were made and paid immediately, it is a definite probability that the amount would not be enough to cover the damage that was done. Treatments and drug therapies take an inordinate amount of money to sort out and many people do not have enough to pay for this treatment themselves in most instances.
This is particularly true with spinal injuries. These could be experienced from car accidents or in the work place. Neck injuries in particular will cause pain all over the body and some people will be in therapy for a number of years. After car accidents, the damage can even take several years to make itself felt and some people will never be able to go back to work again.
When these cases get to court, it is sometimes difficult to quantify how much damage has been done. The expert witness for the complainant will say one thing, and the expert witness for the defense will say another. Indeed, the defense can even send out private investigators to film and stalk the victim to see if they are telling the truth about their injuries.
Photographs and videos will be brought to court to try to disprove the claim and in some instances the claim can be thrown out altogether. However, this being said, there are those people who see compensation as a free ride for the rest of their lives so they do tend to exaggerate their injuries to make sure that they get more money from the insurance company. After the case is settled they miraculously become better and able to enjoy life as they did before.
What the expert does, as far as he is able, is to show that the victim is indeed as damaged as the doctors say. He will advise his client to not try anything unusual in his private life because even still pictures can look as if someone is far fitter than they say they are.
Once all this is put before the court, it is up to them now to work out what compensation, if any, is payable to the victim, but if the other side appeals this amount, the case could still be in court for several more years. Sometimes the case is settled, 'on the steps' of the court which means that the company makes an offer which they gauge will be less than the court will award.
